01 Scope
These Terms of Service apply to the use of the web-based Entgelt-Transparenz.at platform by companies, organizations and their authorized users.
Customer terms that deviate from these Terms apply only if FDM Software GmbH expressly agrees to them in writing.
02 Scope of service
Entgelt-Transparenz.at supports employers with data import, job architecture, information-request workflows, pay-gap analysis, reporting preparation, remediation processes and audit documentation for the EU Pay Transparency Directive.
The platform provides technical functions and working aids. It does not replace individual legal advice, tax advice or employment-law review.
03 User accounts and customer obligations
The customer is responsible for the accuracy of organization data, allocation of roles and permissions and the lawfulness of imported data.
Access credentials must be kept confidential. The customer must inform FDM Software GmbH without delay if unauthorized access is suspected.
- Assign permissions only on a need-to-know basis
- Check import data for accuracy and lawfulness before upload
- Independently observe statutory information and co-determination duties
04 Prices, billing and plans
Prices, feature scope and usage limits are based on the booked plan or offer. Recurring fees are due according to the agreed billing period.
Paid add-on modules or plan changes are activated only after customer confirmation. Statutory VAT is shown separately where applicable.
05 Data, confidentiality and security
FDM Software GmbH treats HR, job and compensation data provided by the customer as confidential and takes appropriate technical and organizational measures to protect the platform.
Where FDM Software GmbH processes personal data on behalf of the customer, the data processing agreement and the privacy policy apply in addition.
06 Availability and changes
FDM Software GmbH aims to provide stable and secure platform operations. Maintenance, security updates, third-party disruptions or force majeure may temporarily limit availability.
Functions may be further developed provided the contractually agreed core benefit is not materially impaired.
07 Liability
FDM Software GmbH has unlimited liability for intent, gross negligence and injury to life, body or health.
For slight negligence, FDM Software GmbH is liable only for breach of material contractual obligations and limited to typical, foreseeable damage. Mandatory statutory liability remains unaffected.
08 Term and termination
Term, notice periods and renewals are governed by the booked plan or individual offer.
After contract termination, the customer may export available data where technically provided and no open obligations prevent this. Data is then removed according to the agreed deletion periods.
09 Final provisions
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer-protection or data-protection provisions prevent this.
Place of jurisdiction is Vienna where legally permissible. If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
